These Terms of Use ("Terms") govern your access to and use of the website operated by Washyrelbowex and your engagement with our workplace wellness programs for office workers. By accessing our website, submitting an enquiry, or purchasing any of our wellness programs, you agree to be bound by these Terms. If you do not agree, please do not use our website or services.

1. About Our Services

Washyrelbowex provides workplace wellness programs designed for office workers in Australia. Our products include the Desk Stretch Break Program ($89 AUD per month), Posture Reset Workshop Series ($249 AUD), and Complete Office Wellness Plan ($499 AUD per quarter), as well as custom program packages tailored to organisational needs. Services are delivered on-site at client workplaces, virtually via video conferencing, or through a hybrid model as agreed at the time of booking.

Our programs focus on movement, posture awareness, ergonomic habits, and stress management through guided physical activity. They are educational wellness services and are not a substitute for professional advice from qualified practitioners where specific conditions exist.

2. Eligibility

Our website and services are intended for individuals aged 18 years and older. By using our services, you represent that you are at least 18 years of age and have the legal capacity to enter into binding agreements. Corporate bookings must be made by an authorised representative of the organisation with authority to commit the organisation to these Terms.

3. Website Use

You may use washyrelbowex.world for lawful purposes related to learning about and enquiring about our office wellness programs. You agree not to:

  • Use the website in any way that violates applicable Australian federal, state, or local laws
  • Attempt to gain unauthorised access to our systems, servers, or databases
  • Transmit viruses, malware, or other harmful code through the website
  • Scrape, crawl, or harvest data from the website without our prior written consent
  • Impersonate any person or entity or misrepresent your affiliation with any organisation
  • Interfere with or disrupt the website's functionality or the experience of other users
  • Use automated systems to submit enquiries or contact forms without human involvement

We reserve the right to suspend or terminate access to the website for any user who violates these Terms.

4. Program Bookings and Agreements

When you enquire about or purchase a wellness program from Washyrelbowex, a separate service agreement may be provided outlining specific terms for that program, including session schedule, delivery format, participant numbers, and payment terms. In the event of any conflict between these Terms and a signed service agreement, the service agreement prevails for matters specific to that booking.

All program prices are listed in Australian Dollars (AUD) and are subject to change. The price confirmed at the time of booking is the price that applies to your purchase. Prices displayed on movement-plans.html are indicative and may be adjusted for custom requirements or larger team sizes.

Bookings are confirmed upon receipt of payment or signed agreement, whichever is specified during the booking process. We will send a confirmation email with session details, facilitator information, and any preparation instructions.

5. Payment Terms

Payment for wellness programs is due as specified in your booking confirmation. Accepted payment methods will be communicated at the time of purchase. For recurring programs such as the Desk Stretch Break Program, monthly charges are billed on the anniversary of your subscription start date.

Late payments may result in suspension of scheduled sessions until the outstanding balance is settled. We reserve the right to charge reasonable interest on overdue amounts as permitted under Australian law.

All fees are exclusive of GST unless otherwise stated. Where GST applies, it will be added to the quoted price in accordance with Australian tax legislation.

6. Cancellation and Refunds

Cancellation and refund terms for our wellness programs are set out in our Return Policy. Please review that policy carefully before making a purchase. By booking a program, you acknowledge that you have read and understood our cancellation and refund procedures.

7. Participant Responsibilities

Participants in Washyrelbowex wellness programs are responsible for:

  • Disclosing any physical limitations or concerns to the facilitator before sessions begin
  • Participating within their own comfort range and informing the facilitator if any movement causes discomfort
  • Wearing appropriate clothing for gentle movement activities
  • Arriving on time for scheduled sessions, whether on-site or virtual
  • Ensuring a safe space is available for virtual sessions with adequate room to move arms and stand if needed
  • Not attending sessions if experiencing acute illness that may affect participation or pose a risk to others

Participation in all sessions is voluntary. Participants may opt out of any specific movement without explanation.

8. Client Organisation Responsibilities

Corporate clients booking programs on behalf of their teams agree to:

  • Provide accurate information about team size, workspace layout, and scheduling requirements
  • Ensure a suitable space is available for on-site sessions, including adequate floor space and ventilation
  • Communicate session schedules to participating employees in a timely manner
  • Obtain any necessary internal approvals for wellness program participation
  • Designate a contact person for coordination with Washyrelbowex facilitators
  • Comply with workplace health and safety obligations relevant to hosting on-site sessions

9. Intellectual Property

All content on washyrelbowex.world, including text, graphics, logos, program materials, session guides, and software, is the property of Washyrelbowex or its licensors and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission.

Program participants receive a limited, non-transferable licence to use session materials and guides provided during programs for personal workplace wellness purposes only. Redistribution, commercial use, or public display of our proprietary materials is prohibited.

10. Disclaimer of Warranties

Our wellness programs are provided on an "as is" and "as available" basis. To the maximum extent permitted by Australian Consumer Law, we make no warranties, express or implied, regarding the website or our services, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

While our programs are designed based on occupational health principles and facilitator expertise, individual results may vary. We do not guarantee specific outcomes from participation in our wellness programs. Our services are educational and promotional of general workplace wellbeing and are not tailored clinical interventions.

The website may occasionally be unavailable due to maintenance, technical issues, or circumstances beyond our control. We do not warrant uninterrupted or error-free access to washyrelbowex.world.

11. Limitation of Liability

To the fullest extent permitted by law, Washyrelbowex, its directors, employees, contractors, and facilitators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website or participation in our wellness programs, including loss of profits, data, or business opportunities.

Our total liability for any claim arising from or related to these Terms or our services shall not exceed the amount paid by you for the specific program giving rise to the claim during the twelve months preceding the claim.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other applicable legislation that cannot be lawfully excluded. Where our liability cannot be excluded, it is limited to the resupply of services or the cost of resupply.

12. Indemnification

You agree to indemnify and hold harmless Washyrelbowex and its personnel from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the website, or your participation in wellness programs in a manner that violates these Terms or applicable law.

If negotiation fails within 30 days, either party may pursue remedies in the courts of Queensland or the Federal Court of Australia, as appropriate.

If you are a consumer under the Australian Consumer Law, you may also have access to dispute resolution mechanisms provided by relevant consumer protection agencies.
